1. Eligibility

You must be at least 18 years old and able to form a binding contract to place an order. By ordering, you represent that you meet these requirements and that the information you provide is accurate and complete.

2. Products, Descriptions, and Availability

We work to describe our tile, stone, slab, vinyl, and cabinetry products accurately, but we do not warrant that product descriptions, specifications, dimensions, or other content are error-free or complete.

Color and appearance: Monitor calibration, screen settings, lighting, and photography all affect how a product appears online. Images and samples are representative only. Natural stone and porcelain vary in shade, veining, and texture between pieces and production lots. We encourage you to view full-size material in one of our showrooms before ordering.

Product availability is not guaranteed. We may limit quantities, discontinue products, or restrict sales at our discretion, provided we do so on a lawful and non-discriminatory basis.

3. Pricing and Errors

All prices are in U.S. dollars and are subject to change without notice. Prices posted online may differ from showroom pricing.

Despite our efforts, pricing and product errors occasionally occur. If an item’s correct price is higher than the price listed, we will contact you before charging you or shipping, and give you the choice of proceeding at the correct price or cancelling for a full refund. We do not charge the higher price without your agreement.

Prices exclude taxes, delivery, freight, fabrication, and installation unless expressly stated.

4. Orders and Acceptance

Your order is an offer to purchase. Our confirmation email acknowledges receipt but does not by itself constitute acceptance. A contract is formed when we ship the merchandise, release it for pickup, or otherwise confirm acceptance in writing.

We may refuse or cancel an order for product unavailability, pricing errors, suspected fraud, or delivery-area restrictions. If we cancel an order you have paid for, we refund you in full.

Special orders require a deposit and are subject to the terms in our Returns Policy.

5. Payment

We accept the payment methods displayed at checkout. You represent that you are authorized to use the payment method provided. Applicable California sales tax is calculated based on the delivery or pickup location.

Financing, where offered, is provided by a third-party lender and is subject to that lender’s credit approval and terms. Orion Flooring is not the lender and does not make credit decisions.

6. Gift Cards

Orion Flooring gift cards are issued in compliance with California Civil Code § 1749.5:

• Our gift cards do not expire
• We do not charge dormancy, inactivity, or service fees
• If your remaining balance is under $10, you may request the balance in cash

Gift cards are not reloadable unless stated, cannot be redeemed for cash except as described above, and are not replaced if lost or stolen without proof of purchase.

7. Measuring, Quantities, and Overage

You are responsible for the accuracy of your measurements and quantities. Any measurement assistance, layout suggestion, or square-footage estimate provided by Orion Flooring staff is a courtesy, not a guarantee.

We recommend ordering 10–15% more material than measured to account for cuts, waste, pattern layout, breakage, and future repairs. We cannot guarantee that additional material from the same shade lot will be available later.

8. Installation Services

Where Orion Flooring provides or arranges installation, the work is governed by a separate written home improvement contract, not by these Terms. Nothing on this website constitutes a binding installation quote.

Orion Flooring Inc. is a licensed California contractor. Our CSLB licence number appears on our written estimates and installation contracts, and can be verified through the California Contractors State License Board at cslb.ca.gov.

California home improvement contracts have mandatory content requirements, down-payment limits, and cancellation rights. Those terms are set out in your signed installation contract, which governs the work and takes precedence over this website.

If you use your own contractor, that contractor is not our agent, and we are not responsible for their work, timeline, conduct, or costs.

9. Right to Cancel Certain Sales

If you sign a contract with us in your home or somewhere other than our normal place of business, California’s Home Solicitation Sales Act generally gives you the right to cancel within three business days (five business days if you are 65 or older, for home improvement contracts). Where this applies, we will give you written notice of your cancellation rights and a cancellation form at the time you sign.

10. Shipping, Damages, and Returns

Delivery, inspection, damage reporting, and return terms are set out in the following policies, which form part of these Terms:

Delivery dates are estimates. Do not schedule installation labor until your order is delivered and inspected.

11. Warranties

Products sold by Orion Flooring carry the warranty, if any, provided by the manufacturer. Manufacturer warranties generally require professional installation, proper subfloor preparation, correct setting materials, and appropriate maintenance, and are typically voided by improper installation or misuse.

Except for manufacturer warranties and any warranty we give you in writing, and except as stated in the paragraph below, this website and our products and services are provided “as is,” without warranties of any kind, express or implied.

Your California warranty rights are not waived. Under the Song-Beverly Consumer Warranty Act, consumer goods sold in California come with implied warranties of merchantability and fitness that generally cannot be disclaimed when the goods are sold with an express warranty or a service contract. Nothing in these Terms disclaims, limits, or shortens any implied warranty or other right you have under Song-Beverly, the Consumers Legal Remedies Act, or other California law.

12. Limitation of Liability

To the maximum extent permitted by law, Orion Flooring’s total liability arising from or related to any order shall not exceed the amount you paid for the product giving rise to the claim, and we shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost wages, contractor or installer fees, storage costs, delay costs, or loss of use.

These limits do not apply to personal injury or death, fraud, willful misconduct, gross negligence, violation of law, or any other liability that cannot lawfully be limited — including under California Civil Code § 1668, which voids contract terms purporting to exempt a party from responsibility for its own fraud, willful injury, or violation of law.

13. Suitability and Slip Resistance

You are responsible for selecting products appropriate for your intended application. Not all tile is suitable for floors, wet areas, exterior use, freeze-thaw conditions, or commercial traffic. All flooring can become slippery when wet. Consult product specifications, DCOF ratings, and a qualified professional for your project.

14. Proposition 65

WARNING: Some products sold by Orion Flooring, and dust created by cutting, grinding, or drilling tile, stone, and engineered stone, can expose you to chemicals including crystalline silica, known to the State of California to cause cancer. Cutting and finishing should be performed with proper wet-cutting methods, ventilation, and respiratory protection. For more information go to www.P65Warnings.ca.gov.

15. Intellectual Property

All content on this site — text, graphics, logos, photographs, product imagery, layouts, and software — is owned by Orion Flooring or its licensors and is protected by copyright, trademark, and other laws. You may not reproduce, distribute, modify, scrape, or create derivative works from our content without our prior written permission.

“Orion Flooring” and our logo are trademarks of Orion Flooring. Third-party brand names on the site are the property of their respective owners.

16. Acceptable Use

You agree not to:

• Use the site for any unlawful or fraudulent purpose
• Interfere with, disrupt, or attempt to gain unauthorized access to the site or its systems
• Use bots, scrapers, or automated tools to harvest content, pricing, or data
• Introduce malware or attempt to circumvent security measures
• Impersonate another person or misrepresent your affiliation

17. Accounts

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts for violation of these Terms.

18. User Content and Reviews

If you submit reviews, photos, comments, or other content, you grant Orion Flooring a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with our business. You represent that you own the content and that it does not infringe anyone’s rights. We may remove any submission that violates these Terms.

We do not condition any discount, refund, or benefit on your writing a positive review, and we do not remove reviews simply because they are negative.

19. Third-Party Links

Our site links to third-party websites, including financing providers, manufacturers, and social platforms. We do not control and are not responsible for their content, products, or privacy practices.

20. Promotions

Coupons, discounts, and promotions are subject to their stated terms, cannot be combined unless expressly permitted, have no cash value, and may be modified or withdrawn prospectively at any time.

21. Communications and Electronic Records

By providing your phone number or email address, you consent to receive transactional messages about your order. Marketing calls and texts are sent only with your prior express written consent, and you may opt out at any time by replying STOP or using the unsubscribe link. Message and data rates may apply. You agree that contracts, notices, and disclosures may be provided electronically and that electronic signatures have the same effect as handwritten ones.

22. Force Majeure

We are not liable for failure or delay caused by events beyond our reasonable control, including natural disasters, fire, flood, extreme weather, labor disputes, port congestion, customs delays, carrier disruption, supply shortages, utility or network failures, war, civil unrest, epidemics, or government action.

23. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

For business and commercial customers, any dispute shall be brought in the state or federal courts of the State of California.

For consumer purchases, nothing in these Terms limits your right under California Code of Civil Procedure § 395 to bring an action in the county where you reside, where you signed the contract, or where the goods are located. A venue clause cannot override that right.

24. Indemnification

You agree to indemnify and hold harmless Orion Flooring and its owners, officers, employees, and agents from claims, damages, losses, and reasonable expenses arising from your breach of these Terms, your misuse of the site, or your violation of law or a third party’s rights. This does not apply to claims arising from our own negligence or misconduct.

25. Severability and Waiver

If any provision of these Terms is found unenforceable, it shall be limited or removed to the minimum extent necessary, and the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver of it.

26. Changes to These Terms

We may update these Terms by posting a revised version with a new “Last updated” date. Continued use of the site after changes constitutes acceptance of the updated Terms. The Terms in effect at the time of your order govern that order, and we will not apply changes retroactively to completed purchases.
